Summary | MHOs have additional specific duties under the Adults with Incapacity (Scotland) Act 2000 and responsibilities under the Adult Care and Protection (Scotland) Act 2007 in relation to adults who may be at risk of harm as a result of learning disability, acquired brain injury, dementia and autistic spectrum disorders. This unit will address the necessary skills and knowledge required for the MHO role in relation to this legislation. It will also explore the nature of incapacity in the context of multi-disciplinary assessment, care and treatment of individuals and in relation to their families and carers. The practice component will assess the student¿s ability to appropriately apply the legislation, critically reflect upon the practice dilemmas and inter-professional tensions and also to consider the issues of using professional authority, autonomy and accountability in this area of practice within the MHO role. |

Learning Outcomes
On completion of this course, the student will be able to:
- Consider mental well being in relation to health, human growth and development; sustaining independent living; the nature of capacity and incapacity in relation to the specific range of mental disorders.
- Critically apply and integrate knowledge of MHO practice in carrying out the duties and responsibilities of the MHO role under the Adults with Incapacity (Scotland) Act 2000.
- Critically apply lawful interpretations of capacity/incapacity in relation to legislative duties and responsibilities.
- Critically apply knowledge of specific and core legislation in - Critically apply knowledge of assessment and evaluation of risk to adults, their families and significant others and address the rights of that individual and others involved in the statutory processes.
