Summary | The aim of this course is to examine the law of contract from a comparative perspective. Reference will be made to civilian and common law systems (including mixed systems) and, in particular, the laws of Scotland, England, France and Germany. Students will be encouraged to criticise constructively current laws and to suggest and evaluate possible reforms. They will also be encouraged to develop written and oral skills through class discussion and assessments. Part of each seminar involves the discussion of legal problems. The class assessments also take the form of essays answering problem questions. Thus, both in seminars and in assessments problem-solving skills are developed. |

Assessment is by way of written answers to seen problems. the first is worth 40%, the second 60%. |
Feedback |
In most sessions, there are case studies dealing with the topic being studied that week. Students are split into groups to consider the case study by reference to a particular jurisdiction. Each week a different spokesperson from each group reports back to the class on his/her team's views on the particular jurisdiction the team were considering. Feedback is provided on how the case study problem has been analysed to assist students for the problem questions in the assessment. |

Learning Outcomes
By the end of the course students should be able to demonstrate (1) a critical knowledge and understanding of the law of contract; (2) an appreciation of the comparative approach to legal study; (3) an ability to comment critically and engage in debate on the issues examined; (4) an ability to suggest practical solutions to the problems considered.
