| Course description | This module will enable you to apply knowledge of IP law in a practical context. The course will give you an understanding of how IP is identified, managed, protected, and exploited in a commercial setting as well as introducing you to litigation mechanisms through which rights can be enforced. The role of competition law in commercialisation of IP rights will also be studied. International, European and national materials will be applied in addition to case studies, which will enable you to gain an appreciation of the complexities involved in managing intellectual property in practice.
Practicing solicitors with expertise in different areas of intellectual property law have helped to develop the sessions within this module, which has ensured that this module maintains a highly practical focus.
Sessions will cover:
Generating IP (including ownership and employment issues)
IP as an asset (including use of IP to raise finance)
Dealing in IP (including licensing and transfer of rights)
Trade mark protection and brands
Patent protection and technology
Copyright exploitation and management
Technology transfers
Commercialisation (including distribution, agency and franchise)
Infringement and evidence
Litigation and remedies

Summary of Intended Learning Outcomes
The aims of this module are to:
- Examine the processes involved in identifying intellectual property owned by commercial concerns, ownership thereof, and registering relevant rights at national, European and international level;
- Consider how infringements of intellectual property rights may be monitored and enforced and conduct of IP disputes;
- Investigate the role of competition law in this context;
- Analyse different methods of exploiting and commercialising IP rights and examine problems relating to jurisdiction, choice of law and enforcement of IP rights in the UK and Europe and consider how these might be best managed.
At the end of the module the student will be able to :
- Recognise the complexities in identifying and managing IP within commercial concerns;
- Evaluate the most appropriate mechanisms for protecting and thereafter exploiting intellectual property at national, regional and international level;
- Make informed judgements as to the role of competition law in this context;
- Analyse and apply the relevant international private law rules to transnational intellectual property disputes, and recognise and evaluate key legal and evidential issues arising in IP disputes. |
Assessment Information
| One essay of up to 5,000 words (60%); two pieces of assessed work (10% each); contribution to online discussions (20%). |
